I. PURPOSE AND SCOPE OF APPLICATION

These stipulations aim to regulate the use of the electronic sales services for the various goods and services offered by Mas Maletas y Bolsos SL, hereinafter JASLENSHOPS, a commercial company that operates on the Internet from its website www.jaslenshops.com, selling to its customers travel items, handbags, school backpacks, and leather accessories.

The clauses listed below form the framework contract that all users who access the website www.jaslenshops.com are required to know and accept. For the sole purpose of these general conditions, the term "user" includes any internet user who accesses the website www.jaslenshops.com, whether directly or from any other Internet site.

The services offered by JASLENSHOPS on this website will be governed by the conditions contained in this contract. JASLENSHOPS reserves the right to modify these general conditions in whole or in part, with the new ones being applicable from the moment they are published on the website. In any case, the mentioned modifications will not have retroactive effects on the goods or services already previously contracted by users.

These General Conditions bind both parties and form an integral and inseparable part of the purchase contract, whose effectiveness operates at the moment the order is placed at the request of the customer through the contracting mechanisms that will be specified later, all in accordance with the provisions of Article 1,255 of the Civil Code, which reflects the principle of autonomy of the will and agreements between the contracting parties. For all purposes, it will be understood that by placing an order, the user accepts the conditions and rules of use mentioned herein.

To fully guarantee the rights of consumers and users of JASLENSHOPS, these General Conditions are established in accordance with Spanish law, and particularly with Law 3/2014 of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 7/98 of April 13 on General Contracting Conditions, Law 7/96 of January 15 on the Regulation of Retail Trade, Civil Code, Directive 2000/31/EC of the European Parliament and Council of June 8, Royal Decree-Law 7/2021 on the sale of goods and the supply of digital content or services, and Law 34/2002 of July 11 on information society services and electronic commerce.

Its contact email address is shop@jaslenshops.com. The address for complaints will correspond to the registered office of the company.

III. OBJECT

These General Conditions regulate the contracting of products and services offered by JASLENSHOPS and the advertising directed at its customers/users, all through its website, as well as the rights and obligations of the parties arising from the sales operations agreed between them.

IV. LEGAL CONDITIONS FOR THE PROVISION OF THE SERVICE AND RESPONSIBILITY, CLARITY, AND TRANSPARENCY IN INFORMATION

JASLENSHOPS, in compliance with the provisions of Article 10 of Law 34/2002 of July 11, through its website and these General Conditions, provides permanent, easy, direct, and free electronic access to information regarding its legal name (fiscal, registration data, address, and communication information), as well as customer data, exclusively accessible to the customer, that is held by the company.

V. CONDITIONS OF ACCESS FOR THE USER/CUSTOMER

The user of the JASLENSHOPS website will have the right to free access to the public information available on the site, although JASLENSHOPS reserves the right to restrict access to information, promotions, and special offers to its registered customers.

Any user who accesses the JASLENSHOPS website has the right to register as a customer and can, therefore, take advantage of special offers intended for the group of registered customers if they meet the specific conditions of the offer specified for each product.

The public information contained on the JASLENSHOPS website, referring to both the company JASLENSHOPS and the brands, products, logos, etc., of the wholesalers and manufacturers of the offered products and services, is protected by legal provisions on intellectual and industrial property. Therefore, copying, transmission, transfer, sale, or use by the customer for purposes other than the advertising purpose of its virtual publication is not authorized without the express consent of JASLENSHOPS or the product manufacturer or the owner of the brands and logos, as provided in section XI on Industrial and Intellectual Property Rights.

USER REGISTRATION

Before completing the purchase of any of the products offered by JASLENSHOPS, the customer/user must register their personal details and circumstances necessary for formalizing the purchase contract (name and surname or legal name, ID/NIF, address, email address, telephone/fax number).

To place orders on the website, each customer will voluntarily and under their responsibility provide JASLENSHOPS with their personal data.

All personal data provided fraudulently or falsely by customers may be considered a crime of falsifying commercial documents.

JASLENSHOPS may offer the customer a personal registration system through a personalized access key (login) and a password to facilitate future purchases. In this case, the customer can designate their desired access key and password, provided they are available and not already assigned to other customers. Through an automatic process, JASLENSHOPS, if the customer so wishes, will generate the access key and password for the customer. Keys or passwords containing immoral, injurious, offensive, discriminatory content or those that contravene the provisions of the laws, or those referring to brands, products, or names protected by legal provisions on Intellectual Property, Industrial Property, or contrary to rights to privacy, honor, and one's image, will not be accepted.

The customer agrees to ensure the confidentiality of their access key and password. JASLENSHOPS is exempt from any responsibility arising from improper use or negligence by the customer in fulfilling their obligation to maintain the confidentiality of their access keys.

VI.- OFFER AND ACCEPTANCE PROCESS.

TERMS OF SALE AND PRODUCT DELIVERY

Pricing Policy: JASLENSHOPS reserves the right to modify the prices of the products and services offered on its website at any time and unilaterally. To ensure the customer's confidence and security regarding the price of their products, the price will be the one in effect at the time the order is placed.

In the electronic purchasing process, the following steps will be followed according to the options menu provided on the JASLENSHOPS website:

Information about the product offered to the customer: This includes the description, manufacturer brand, and indicative photograph (if applicable).

The purchased product may undergo non-substantial modifications in components, characteristics, or features due to manufacturer availability, as long as these changes do not diminish the advertised quality and performance.

Information about the product price: This includes the final price or the retail price of the product to be purchased, which includes the final cost for the customer, including VAT, shipping costs, and insurance for goods and handling related to transportation. Therefore, the final cost will be communicated to the customer during the electronic purchasing process before they finalize their acceptance by selecting the "order acceptance" option from the options menu. Any possible discounts or promotional gifts will be freely directed by JASLENSHOPS to the groups designated at any given time by JASLENSHOPS or based on the product offered, as per the existing advertising on their website.

Shipping costs for orders within mainland Spain will be free for those exceeding 150 euros.

Order acceptance: Once the order is placed, and the "order acceptance" option is selected, the customer’s consent is understood to be given for the validity and effectiveness of the sales contract, which is binding on both parties. JASLENSHOPS will electronically store the order.

The commitment made by JASLENSHOPS to sell and deliver the offered goods is subject to the availability of the advertised product and its availability while supplies last. Therefore, JASLENSHOPS, in its commitment to quality and customer service, strives to ensure that the advertised products are available at all times. However, if exceptional circumstances of multiple interactive orders or other circumstances cause the product to run out of stock, the order and the contract between the parties will be rendered null and void by this resolution clause, fully refunding the customer for any prepaid amounts without any compensation for breach of contract, damages, or loss of profit to either party.

JASLENSHOPS will confirm the acceptance of the order to the customer through the method of their choice: email, fax, or postal mail. The sale will not be finalized until JASLENSHOPS confirms the order.

JASLENSHOPS reserves the right not to confirm an order for specific reasons such as product supply issues, a problem related to the received order (e.g., illegible document), an abnormal order, or a foreseeable delivery issue. JASLENSHOPS will inform the customer of this.

Payment Methods: The following payment methods are available:

Mas Maletas y Bolsos SL provides its customers with the option to pay via bank transfer, PayPal, and credit/debit cards (Visa, Mastercard, or Visa Electron) through the addonPayments gateway from Caixabank.

For credit/debit card payments, we do not store or access card information. All transactions are processed directly by Caixabank and the Addon Payments platform on their highly secured servers. The Addon Payments gateway from Caixabank is secure and a national benchmark in online transactions. It is certified according to Secure Electronic Commerce (CES) protocols and is based on the 3D Secure system, also known as "Verified by Visa" for Visa, and "SecureCode" for Mastercard.

3D Secure: Verified by Visa - SecureCode

In practice, 3D Secure means that we will provide our card number, expiration date, and security code to the online store's virtual payment terminal, but after providing this information, we will be redirected to the card issuer's website, which will request additional information known only to the cardholder and the bank. The information will be requested according to the authorization mechanism established by the bank, and each bank is free to apply the one it deems appropriate.

Invoice: JASLENSHOPS will issue an electronic invoice (PDF) that will be sent via email once the sale is completed. JASLENSHOPS advises that invoices cannot be modified afterward in compliance with current regulations (Royal Decree 1496/2003 on Billing Standards, modified by Royal Decree 87/2005). The invoice will be issued in the name of the person or company placing the order, so the customer must ensure that the order is placed in the correct name. Changes will not be possible afterward.

Delivery time for the purchased product: Our current quality commitment ensures that all confirmed orders on a given day (8:00 a.m. to 5:00 p.m.) will be shipped before 7:00 p.m. on the next business day, except in cases where the committed shipping time is explicitly indicated in the product information. Confirmed orders will be considered those with payment by cash on delivery, or if by transfer, where the transfer has been verified.

In the event of a stock shortage due to any incident, our customer service department will inform the customer of any delay, providing the option to cancel or change the order.

Once the order is shipped, delivery times will adhere to the conditions of the contracted shipping service if included, or selected, if it involves destinations not covered by any contracted transport service.

All shipments are made on business days from Monday to Friday, so purchases made on Fridays will not be processed until the next business day.

Place and method of delivery: The order will be delivered to the address provided by the customer at the time of ordering. Subsequent changes to the delivery location requested by the customer may incur additional costs to the sales price, which will be borne by the buyer. The goods will be delivered to the customer by a transport company, along with a delivery note specifying the customer’s information, the order, and the number of packages in the shipment. The goods are always covered against transportation risks, loss, and handling.

If the customer detects errors in the received goods or if they are visibly damaged at the time of delivery, these circumstances must be noted on the carrier's delivery note and reported to JASLENSHOPS within 14 business days by writing or emailing shop@jaslenshops.com through the customer service published on the website, using the withdrawal form provided for this purpose, directed to the email or the company's registered address. In any case, the customer must verify that the goods have been delivered in perfect condition. Claims made more than 14 business days after delivery will not be accepted.

If, after receiving an email notification that their order has been shipped, the customer does not receive the product within the indicated shipping times, they can contact us again via phone at 962356629 (during office hours) or email at shop@jaslenshops.com, so that we can clarify the cause of the delay with the transport company.

In the event of delivery being impossible due to force majeure, disaster, strike, administrative decision, or transport strike that delays, prevents, or makes supply unreasonably expensive, this constitutes, by express agreement, a suspension or termination clause of JASLENSHOPS's obligations, without compensation to the customer if the cause persists for more than 15 days. In these circumstances, the customer will be fully and automatically exempt from their obligations regarding their order.

JASLENSHOPS will inform the customer through any appropriate means on the same day that the incident occurs so that the customer can freely cancel their orders by responding by postal mail or email once the cause is notified.

If the Customer is absent at the time of delivery, the carrier will leave a notice indicating how to proceed to arrange a new delivery. If the order cannot be delivered after 7 business days from the delivery attempt, the Customer should contact JASLENSHOPS. If no contact is made, the product will be returned to the warehouses after 10 business days, and the Customer will bear any associated costs.

If the delivery could not be made due to the carrier losing the product, an investigation will be conducted, and the customer will be resolved within a maximum of 15 business days.

VII.- PRODUCT WARRANTY

The warranty for products sold by JASLENSHOPS is provided and established in accordance with the existing legal framework for consumer goods warranties, a legal framework designed to provide the consumer with various options to demand a remedy when the purchased product does not conform to the contract, giving them the option to request repair or replacement of the product unless it is impossible or disproportionate. When repair or replacement is not possible or is disproportionate, the consumer may request a price reduction or contract termination.

Commercial Warranty: Manufacturers may offer additional warranties, the scope and duration of which vary depending on the products and brands. These warranties are solely the responsibility of the manufacturer who offers them. Under this law, the seller is obligated to deliver to the consumer goods that conform to the sales contract as established by the law. Therefore, as established in Article 4 of the aforementioned law regarding the seller's liability and the buyer's rights: "The seller shall be liable to the consumer for any lack of conformity that exists at the time of delivery of the goods. Under this law, the consumer is recognized as having the right to repair the goods, replace them, reduce the price, or terminate the contract." In any case, the product lot number must match JASLENSHOPS's records for the product to be repaired.

JASLENSHOPS will not be responsible for any potential damages resulting from misuse or improper handling. The warranty will not be valid in cases of external factors unrelated to the normal use of the product by the customer or by third parties not authorized by the manufacturers. The warranty period will begin on the day of delivery.

VIII.- CLIENT RIGHTS

  • Confidentiality and Security: The confidentiality and security of the client's personal data are maintained in accordance with current Spanish data protection laws. Client data will not be shared, transmitted, or published without explicit consent. Clients will not receive promotional or advertising emails if they have opted out. Clients have the right to consult, modify, and delete their personal data stored in the JASLENSHOPS database upon request, in accordance with the Personal Data Protection section.

  • Access: Clients have free access to the open sections of the JASLENSHOPS website and can check the status of their order at any time.

RETURNS

  • Unilateral Withdrawal/Revocation of the Order: In accordance with Article 104 of Royal Legislative Decree 1/2007, approving the General Law for the Defense of Consumers and Users, the client (considered as consumers or users only if they are individuals or entities that purchase, use, or enjoy the product as end users) has the right to revoke the requested order within fourteen days of receiving it, with prior communication to JASLENSHOPS within that period to establish the appropriate return procedures (return number, method, and address for return shipment). Only the price of the product paid by the client will be refunded. If the right of withdrawal is exercised, the client will bear the return costs and any damages suffered by the product or goods. Returns will not be accepted in cases of use, broken seals, or opened containers, unless noted on the delivery slip. Return costs will be deducted from the product price at the time of refund. Return or exchange transactions cannot be processed at our headquarters.

  • JASLENSHOPS' Responsibility: JASLENSHOPS will not accept returns of products that have been tampered with by the client or goods returned incomplete in terms of their main components or accessories. The right of withdrawal will not apply outside the specified period or for products that, due to their nature, cannot be returned. Additionally, returns will not be accepted for goods or orders considered custom-made according to the client’s specifications.

  • Exceptions to Returns: Under Article 103 of the General Law for the Defense of Consumers and Users, the following are exempt from returns:

    • Customized products made according to the consumer's exact specifications.

  • Professionals: Individuals or entities who purchase, store, use, or consume goods or services for integration into production, transformation, commercialization, or provision to third parties are not considered consumers and users and do not benefit from the rights granted to consumers.

Product Return Instructions

  • Returns will not be processed directly at our facilities but should be given to the carrier for shipment. To avoid any issues, smaller products should be protected with external packaging—just as you received them at your address—to prevent any damage or tampering with the original packaging during transport. For larger products, external packaging protecting the original is not necessary, but it is important to ensure that the product is properly protected inside the original box with protective materials (foam, polystyrene, bubble wrap, etc.) to avoid any tampering. IX.- USER/CLIENT OBLIGATIONS

  • Safeguarding Personal Credentials: Clients must carefully safeguard their personal credentials.

  • Use of Information: Clients must use the information published by JASLENSHOPS strictly within the context of the intended personal commercial relationship.

  • Prohibition of Reproduction: Clients are prohibited from reproducing, selling, or otherwise disposing of the information published by JASLENSHOPS without the company’s express permission.
